In a day and age of increasing construction-defect lawsuits, it is essential for developers and builders to afford themselves greater protection in the sale of their condominium projects by distributing Maintenance Manuals to the homeowners and the association in order to create a maintenance obligation.

Providing the Manuals fulfills two purposes: (i) it becomes less likely that deferred maintenance will cause problems that could lead to litigation, and (ii) if the information and instructions are not followed, the developer may have a defense to claims that are made.
